Police Interview

If you have been arrested or invited for an interview under caution by the Royal Military Police (RMP) or theSpecial Investigations Branch (SIB) then it is crucial that you obtain legal advice immediately.

Even if you do not believe you have committed an offence it is important that you have a solicitor with you during your police interview. Having a solicitor means that you will be more likely to find out prior to your interview the nature and strength of the evidence against you through your solicitor. Your rights will be explained and tactical decisions will be made regarding your defence and approach to the interview at an early stage. You will receive detailed advice on the offences you have been accused of and the implications of the Armed Forces Act 2006.

Courts Martial & Appeals

Appearing before a Courts Martial can be a daunting experience. It is important that you are robustly defended.

Our in-house Solicitor Advocate, James Foster, defends Armed Forces regularly before the Courts Martial at trial. Recent successes include:

  • R v J: WO2 accused of sexually assaulting fellow serving soldier. Following representations regarding expert evidence, and obtaining previously undisclosed material from the prosecution which significantly undermined their case, the Defendant was acquitted on all charges.
  • R v G: WO1 accused of verbally abusing and using violence towards multiple members of the public. Following careful analysis of CCTV and forensic cross-examination of witnesses the Defendant was found Not Guilty after trial.
  • R v R: Private accused of assaulting a civilian during a street fight in Sennelager. Case Dismissed before trial.
  • R v D: Private who pleaded guilty to a charge of desertion having been absent without leave for 5 years. Sentenced to a Community Order and prison avoided.

We are experienced and sensitive to psychiatric issues that defendant’s may have and therefore we retain the services of a handful of trusted and nationally respected psychiatrists and psychologists who prepare reports on our behalf, particularly in respect of Post Traumatic Stress Disorder (PTSD).
